A New Executive Order Eliminates Disparate Impact Protections—What Comes Next for Language Access?

Bruce is nationally recognized for his expertise in language, disability access, and compliance. He serves as the Americans with Disabilities Act (ADA) Consultant to the Idaho Supreme Court and the New Mexico Administrative Office of the Courts. Bruce is a former Senior Trial Attorney with the U.S. Department of Justice. He is on the faculty of Georgetown University School of Medicine and the University of Pittsburgh School of Law, where he teaches Implicit Bias in Health Care. He has also taught at Harvard University, Cornell University, Auburn University, The Johns Hopkins University School of Public Health, and the University of Baltimore School of Law.
On April 23, the President signed an Executive Order that prohibits federal agencies from determining that state or local policies are discriminatory based solely on their disparate impact on individuals due to race, national origin, language, or other protected characteristics. This marks a significant shift in civil rights enforcement and effectively ends the use of “disparate impact” as a tool to address systemic discrimination.
For decades, disparate impact analysis has been a critical mechanism to ensure fair access to public services, including language services for Limited English Proficient (LEP) communities.
